Cornwall Street professional discipline specialist Jonathan Storey (instructed by Lynne Hardy of the National Education Union) has this week secured the acquittal of a teacher charged with inappropriate physical contact with a pupil and associated dishonesty.
His client, a teacher from the North East of England, faced two charges relating to an incident in which he was alleged to have pushed a pupil who fell, and two charges in which he was said to have been dishonest about his conduct in an internal memo and in an interview with the Deputy Headteacher.
After a contested hearing before a Professional Conduct Panel of the Teaching Regulation Agency, involving six witnesses and a number of legal issues, the panel accepted Jonathan’s submissions that the physical contact involved did not amount to serious misconduct, and that his client’s conduct had not been dishonest.
