5.30pm  Paul Harris SC asks the question – “Can my client get rid of that old restrictive covenant that is stopping him developing his land?”

The answer will often be “Yes”, but this area of law is complex and fact sensitive.

Paul Harris , who has recently been dealing with removal of a restrictive covenant from former agricultural land in the Midlands, will give a guided tour of the main issues, pitfalls, and tactics, with a review of the leading cases.

6.00pm  Simon Bradshaw, The Head of our Civil Team, discusses executing a deed –

“The formal requirements for executing a deed include that signatures must be attested by a witness. Given that this requirement dates back to the Statute of Frauds 1677, one might think that any question of what this involves has long since been settled.

But last year the High Court had to consider a situation where, surprisingly, there was no authority in case law: what happens if several people sign a deed, but just one witness makes a single signature attesting this?

Simon acted for the defendants in Euro Securities & Finance Ltd v Barrett and ors [2023] Ch 279 and explains both how the court approached this question, and how to avoid such issues ending up in litigation.”
