Faye, who represented the Applicant father, secured that no findings were found proven against her client following a complex and highly sensitive 5 day trial.

The trial determined 3 allegations of rape and 1 allegation of assault against the Respondent mother. Extremely intimate details were put before the court surrounding the parties relationship, including lengthy text message and video evidence, which required a careful and sensitive approach to cross-examination.

The matter also required a detailed exploration of the legal defence to rape and a ‘reasonable belief’ regarding consent.

Moving forward from the allegations and the Finding of Fact trial, this case, which started out as a child contact dispute between two parents, will now continue to progress through the welfare stage in the hope that the father is able to maintain a close and meaningful relationship with the child.
