Kellie Enever, instructed by Jonathan Lynch of Lynch Law, represented an ex naval petty officer accused of sexual assault.
After a two day trial, the defendant was convicted. At the sentencing hearing the SPA submitted that this was an offence that attracted a sentencing range of 1-4 years, with a starting point of 2 years.
After mitigating and making submissions on the sentencing guidelines, which were contrary to that of the SPA, the Judge Advocate and Naval Board were persuaded to impose a two year community order with requirements.
