Maria Aisha, instructed by Faisal Sameja of The Reflective Practice, secured the acquittal of her client following a successful half-time submission of no case to answer at the Education Workforce Council (EWC) in Cardiff.

Maria’s client was accused of unacceptable professional conduct in allegedly failing to organise and deploy resources in the school, set out and implement performance management structures, agendas and management meetings, consult and communicate with the governing body, staff, parents and pupils and treating staff in an intimidatory, and inappropriate manner. The EWC’s case was predominantly based upon hearsay evidence and the EWC presented no first-hand evidence from anyone from the school.

Maria made a half-time submission of no case to answer. The Fitness to Practice Committee accepted Maria’s submission that the evidence presented by the EWC was insufficient, tenuous and inherently weak and the evidence even taken at its highest was incapable of proving the allegations and the allegations even if proven could not amount to unacceptable professional conduct.

The case was listed for five days but concluded on the fourth day.
