Danae Larham, instructed by Skeila Hicklin of Clark Brookes Turner Cary Solicitors, successfully defended a man alleged to have assaulted by digital penetration, his long-term partner. The man was also charged with assault occasioning actual bodily harm and strangulation against the same woman, and perverting the course of justice. The Crown had instructed a KC to prosecute.

The Crown’s case was supported by photographs of injuries. The defence was one of self defence in relation to the injuries, and fabrication in relation to the assault by penetration.

Several applications were made on behalf of the Crown, which Danae successfully defended. Danae also forensically cross examined the complainant, highlighting inconsistencies within her account. 

The jury returned not guilty verdicts to all 4 counts on the indictment, after deliberating for just 1 hour and 20 minutes.
