Mark Karpinski, instructed by Hayley Davis of Straw and Pearce Solicitors and the Staffordshire Police Federation, this week secured the career of a police constable charged with 3 separate counts before the Police Disciplinary Tribunal, 2 of which were Gross Misconduct.

Following a 3 day hearing both counts of Gross Misconduct were deemed not proved, however simple misconduct had already been admitted by the officer in 2 of the 3 counts. The panel then went on to consider sanction; the Appropriate Authority pushed for dismissal whilst Mr Karpinski argued for a 5 year final written warning.

The panel considered its decision and agreed that a 5 year Final Written Warning would be appropriate.

Mark Karpinski is a specialist criminal law and regulatory practitioner.
