Megan Fletcher-Smith, instructed by John Mohammed & Co, successfully represented a young man at Warwick Crown Court. Her client was alleged to have raped his then-girlfriend whilst she slept.
Megan’s cross-examination of the Complainant demonstrated significant weaknesses in the Prosecution case. Subsequent late disclosure of messages between the Defendant and the Complainant in the weeks and months after the alleged rape led to the Judge staying the indictment as an abuse of process.
The Judge’s decision heavily criticised the police and the prosecution, and commented upon the ways in which the Complainant’s evidence had been undermined during cross-examination. This brings to an end an ordeal for the Defendant, spanning more than 4 years. Megan is known for her robust advocacy and attention to detail.
